Assessments For Booked Inmates Now Indiana Rule

Officials from the state of Indiana are slowly learning the inner workings of a new rule that went into effect on January 1st. The new rules are in regard to criminal justice officials requiring that booked inmates be assessed to determine the risks or benefits of releasing them before trial in an effort to hopefully combat overcrowding at the state’s county jails.

Criminal Rule 26 was adopted by the Indiana Supreme Court back in 2017 but it didn’t take effect statewide until last Wednesday.

The new system requires that all inmates be released on bond or recognizance unless they present a “substantial risk of flight or danger to themselves or others.”

The new rules mandate that an evidence-based risk assessment be used to help make that determination.
